Factsheet on personal data treatment
FARVEST, in its capacity as treatment manager, hereby informs you about your personal data in accordance with Article 13 of Regulation (EU) 2016/679 on the processing of personal data.
Purpose of treatment
FARVEST shall process the personal data you provide when you subscribe to our various information sites and during our own events or a client’s event.
FARVEST shall process your personal data in accordance with applicable laws and regulations governing personal data protection, particularly starting on 25 May 2018, Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
Said treatment also affects related activities taking place during our events, your interaction with our online and mobile applications (onsite registration/online application and initiatives such as newsletters, mailing lists, events, competitions and promotions) and the provision of supplementary information upon request.
When you submit your personal data, you are undertaking to provide accurate, complete and up-to-date information.
a) Purpose of personal data management
FARVEST shall specifically process your personal data for the following purposes: to allow it to subscribe to an event and offer authenticated access to our sites, to respond to your information requests, provide service and potential assistance, including the necessary treatment to manage your electronic subscription to newsletters.
When forms on our sites contain mandatory fields in which you must provide your data, FARVEST shall process them to meet your requirements and for FARVEST’s legitimate interests which consist of identifying people which contact us to thus ensure the management and follow-up of their different requests. These personal data must be provided for such purposes and any potential refusal would prevent FARVEST from conducting said activities, for instance responding to your request to register for an event.
When you provide your personal data via the forms prepared for such purposes, for instance on our sites to subscribe to a newsletter or contact us, or register for an event or training, etc. FARVEST considers that you content to personal data treatment following the use of said forms, for example when you communicate with FARVEST by email following a contact request sent from one of our sites.
When you subscribe to a newsletter, FARVEST shall add your personal data to a software made available to us (SendingBlue). We use this software in order to generate and send you communications (email) in relation to the interests you stated when you subscribe to a newsletter.
b) Other purposes
With your optional consent, FARVEST uses your personal data for marketing purposes, i.e. to send you promotional newsletter on events, commercial or advertising communications, for direct sales or to assess your degree of satisfaction.
Marketing activities are conducted by email (newsletter), telephone, SMS, MMS; chat, online banners, instant messaging, social networks and post, including invitations to events where FARVEST is involved or organised by FARVEST or its business partners.
With your consent, which is optional, FARVEST shall use your personal data for profiling purposes by collecting information related to your preferences, information on your interaction with FARVEST, to create group and individual profiles and, if you have authorised marketing activities, also to send communications and customised promotional deals.
Providing your personal data for the marketing and profiling purposes listed above is optional and any potential refusal shall not affect potential purchases of FARVEST products or the receipt information,
We may also send you market research surveys for non-commercial purposes, which are in no event compulsory, to help us assess and improve the quality of our customer service. We collect the data in your answers to the survey (for services and products).
Methods and legal bases for treatment
FARVEST shall process your personal data with and without electronic tools, on the basis of logics and procedures compatible with the purposes listed above and in accordance with the Regulation, including confidentiality and security profiles.
In accordance with the Regulation, your personal data obtained on a case-by-case basis are used to update and correct information gathered beforehand.
We shall process your personal data based on your consent, a legitimate interest by FARVEST to engage in business activities, obligations arising from a contract between you and FARVEST or statutory obligations.
You have the right to revoke consent at any time, but this revocation shall not affect the legality of any previous treatment.
Recipients of your personal data
Personal data are accessible by duly authorised staff on a need-to-know basis and are disclosed to other exterior entities in the following cases: (i) when the disclosure is required by laws and regulations applicable to lawful third party recipients, such as public authorities and bodies for the respective institutional purposes; (ii) when the communication is necessary to perform a contract or pre-contractual activities initiated at your request, for instance the disclosure of your data to one of our business partners to allow them to provide you with information, products or services as requested; (iii) when the disclosure to third parties is necessary for special operations (e.g. mergers, acquisitions, transfer of companies, etc.).
Your personal data are also shared with our service providers, for example for technical and organisational services, which are functional for the purposes stated above as independent collaborators, as an association, shipping, marketing or payment management company. We shall only provide these entities with the necessary data to provide agrees service, which act as Treatment managers, on the basis of instructions received by FARVEST.
Personal data storage
Your personal data are stored by FARVEST to achieve the goals for which they were collected. Laws impose document storage obligations for accounting and administrative purposes.
Data recorded by our sites/applications shall be deleted at your request.
Treatment manager and Data protection manager
The Data treatment manager is FARVEST S.A.R.L., with offices at 3 Rue Marcel Fischbach L-1547 Luxembourg Kirchberg. The Data protection officer is domiciled at the head office and available at the following email: firstname.lastname@example.org.
You may contact FARVEST as a Treatment holder or Data protection manager as specified above for rectification, erasure, request the portability of data or limited treatment.
In addition, you may, at any time, object to the treatment of your personal data, for direct marketing purposes and, if required for a particular situation, you may object to the treatment of your personal data processed on the basis of FARVEST’s legitimate interest, unless the genuine grounds for FARVEST to complete the treatment (e.g. exercising or upholding a right in court) are not proven.
